The homework with a clock on it
The audit season continues: all summer we are re-checking our own reporting, piece by piece. Today's file is the one with a legal clock inside it. On 1 December we told the story of what happens when you need a cancer scan next week, and the system offers you next year. On 22 June we published the numbers behind it: Andalucía law guarantees your public surgery within 180 days (120 for the commonest procedures), a first specialist consultation within 60, a listed scan within 30, and when the system misses, you can be treated privately at its expense. In 2023, 53,014 patients in Andalucía blew past the surgical limit. Four filed a claim.
Our verdict then: the right is real, and the system is built so it goes unexercised. Six weeks later, that verdict needs an update, because the thing that made the guarantee a consolation prize is about to make it valuable.
What changed since June
The strike lost its end date, officially. In June the doctors' unions announced that if the summer produced no deal, the autumn strike would be indefinite. On 22 July the off-ramp closed: all 17 regions asked the health minister to reopen the Estatuto Marco — the framework statute governing medical working conditions, and she refused. An open-ended national strike from September is now the planning assumption, not the worst case. Confirmed July 2026.
The summer shrinkage is running now. The Andalusian public health service's Plan de Verano — summer staffing plan has 79 pediatric and neonatal beds closed at Málaga's Materno Infantil hospital, the Los Boliches health centre in Fuengirola dark until 14 September, La Carihuela in Torremolinos closing 18 August, Torrequebrada in Benalmádena shut to mid-September, and emergency waits at Hospital Costa del Sol in Marbella measured in hours. The scoreboards diverged. The Junta's guarantee scoreboard says the overdue-surgery list fell from 53,014 (December 2023) to 22,940 at its June 2025 cut, average wait 108 days, credit to a plan launched in 2024. The broader official cut from December 2025 shows a 173-day average surgical wait, the longest in Spain. Both can be true; they count different things. Neither one is your clock, which is personal, legal, and starts on your inscription date.
There is new capacity inside the guarantee. The €15 to €17 million hospital Estepona built with its own money, last week's audit subject, now runs a surgical block inside the same guarantee system. A western-corridor referral pointed at Marbella may find a faster public date by asking for a derivación — referral review.

The inversion
Here is the part that changes behaviour. A guarantee clock started this month wins either way. If the system delivers your consultation, scan, or surgery inside the legal window before it empties in September, you got treated. If it misses because the strike has emptied the calendar, the miss is documented on a legal clock, and the decree machinery points you at private care with the bill going to the public system. The strike cannot stop your clock; only you can, by declining appointments or never getting registered at all.
So the competent move has flipped. In June the guarantee was a consolation prize for passive waiting. In August it is a scheduling instrument you arm on purpose: get every pending complaint, referral, and test onto the official register now, while the registering machinery still runs, and let the clocks do their work through the autumn. One honest caveat carried forward from June: the reimbursement tariffs date from 1998, claimants historically recovered a fraction of private prices, and nobody can promise you a smooth claim during an unprecedented strike format. The certificate is leverage either way: hospitals find prompt public dates for documented clocks far more often than for patient patients.
What to do this week
Anything you are waiting for: confirm you are actually inscribed on the official register, and get the date. The ClicSalud+ patient portal shows it; Salud Responde on 955 54 50 60 confirms it by phone. A referral letter in your hand starts nothing.
Know the trap: revisiones — follow-up appointments carry no guarantee. Only a first consultation starts the 60-day clock.
The day any clock lapses, request the certificado de demora — delay certificate in writing at the hospital's patient services desk. The administration has seven days to issue it, and it is the key to everything downstream. The bottom line
June's verdict holds: the guarantee is real and almost nobody uses it. What changed is the arithmetic around it. With an open-ended strike confirmed for September and August's closures already running, a clock started deliberately now wins whether the system delivers or fails, and the paperwork costs you one phone call and one written request. The four people who claimed in 2023 were pioneers. This autumn, the paperwork is just prudence.
